By accessing or using Brainmify ("the Platform"), operated by Brainmify ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not access or use the Platform.
Brainmify is a multi-product AI SaaS platform that provides the following services: AI Chat, AI Software Engineer (Builder), AI Recruiter, AI Sales Agent, AI Marketing Agent, and related AI-powered tools. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time.
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep your account information updated. You must notify us immediately of any unauthorized access to your account.
Brainmify offers free and paid subscription plans. Paid plans are billed on a monthly or yearly basis as selected at the time of purchase. Credits are allocated per plan and reset weekly. Unused credits do not carry over between billing cycles unless otherwise stated. All payments are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' prior notice.
You agree not to use the Platform to: generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; impersonate any person or entity; interfere with or disrupt the Platform or servers; attempt to gain unauthorized access to any systems; use the Platform for any illegal purpose; scrape, crawl, or use automated means to access the Platform beyond the intended APIs; or violate any applicable local, state, national, or international law.
Content generated by Brainmify's AI tools is provided "as-is." You are solely responsible for reviewing, verifying, and using any AI-generated content. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. You retain ownership of the content you create using our tools, subject to our license to operate the Platform.
The Platform, including its design, code, features, logos, and documentation, is owned by Brainmify and protected by intellectual property laws. You retain ownership of the content you input and the outputs you generate. By using the Platform, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving our services.
Brainmify integrates with third-party services including but not limited to GitHub, Stack Overflow, and Google. Your use of these integrations is also governed by the respective third-party terms of service. We are not responsible for the availability, accuracy, or content of third-party services.
To the maximum extent permitted by applicable law, Brainmify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action or the theory of liability.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free.
We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
We reserve the right to update these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
